Smithdale Records LLC (“Smithdale”) answers employment and income verification requests on behalf of employers who subscribe (“Clients”), and provides verification results to third parties with a permissible purpose (“Verifiers”). These terms govern both. Employees use the service under their employer’s agreement with us.
Plans are priced by headcount and billed monthly in advance. Requests are unlimited. Headcount is reviewed quarterly; we will move you to the matching tier and tell you first.
You authorize us to connect to your payroll or HRIS, read-only, and to answer requests about your current and former employees according to the authorization rules you set. You may cancel at any time; service continues to the end of the paid month.
You are responsible for the accuracy of your payroll records. We answer from them as they are.
Verifiers pay a per-verification fee, set by the Client whose records are requested and shown before submission. Fees are non-refundable once a result is delivered. Where a Client has chosen to receive a share of verifier fees, we remit it monthly as stated in the Client’s order form.
Verifiers must have a lawful purpose for each request and must obtain the employee’s written authorization before requesting pay information. We may refuse or cancel any request.
No requests for anyone you do not have a lawful reason to verify. No sharing of results beyond the stated purpose. No attempts to access records through the employee or client sign-in that are not yours. We may suspend accounts that break these rules.
Client data stays the Client’s. We use it only to provide the service. On termination, you may export your log, and we delete employee records as described in our Privacy Policy. Our security practices are described in the Trust Center and form part of these terms.
We answer from the records we receive and warrant that we will do so with reasonable care. We do not warrant the underlying records. To the extent the law allows, our liability to any party is limited to the fees paid to us in the twelve months before the claim, and we are not liable for indirect or consequential loss.
Each party will defend the other against third-party claims caused by its own breach of these terms or of applicable law, including the Fair Credit Reporting Act, and will carry insurance reasonable for its role.
Texas law governs. Disputes go to the state or federal courts in Harris County, Texas. We may update these terms with 30 days’ notice to Clients and by posting for Verifiers. Contact: legal@smithdalerecords.com.
